Terms of Service

1. Acceptance of Terms

By accessing, downloading, or using StickTime FPV ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these terms and conditions, you are strictly prohibited from using or accessing our platform.

2. Account Registration and Security

You must provide accurate, current, and complete information during registration and keep your account details updated. You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. The non-commercial use and single-user access certifications you affirm at signup are binding acknowledgments under Sections 6 and 7 and are recorded with your account.

You must be at least 13 years old to create an account. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf. For student accounts provisioned through a school or district, the enrolling school administrator must additionally confirm the student is 13 or older before the account can be created.

3. Nature of Service and Flight Safety Warning

StickTime FPV is a digital flight tracking and analytics platform designed for FPV (First Person View) drone enthusiasts.

  • No Control Over Real-World Operations: We do not manufacture, sell, inspect, maintain, or control any physical drones, hardware, or equipment used by you. We do not provide flight instruction, regulatory compliance advice, repair services, or medical advice.
  • Assumption of Risk: FPV drone flying and racing involve inherent risks, including property damage, severe bodily injury, or death. You expressly assume all risks associated with operating drones while using or referencing our platform, data, or analytics.

4. User Content and Data License

You retain ownership of all flight data, text, graphics, and content you submit or upload ("User Content"). By uploading User Content, you grant StickTime FPV a worldwide, non-exclusive, royalty-free, transferable license to store, process, analyze, and display your data solely to provide and improve the platform's functionality.

5. Prohibited Activities

You agree that you will not, under any circumstances:

  1. Violate laws: Violate any local, state, national, or international laws, regulations, or FAA (or equivalent aviation authority) rules regarding drone flight;
  2. Upload malicious content: Upload malicious code, viruses, or disruptive software;
  3. Interfere with security: Interfere with, disable, or compromise the security or integrity of the platform;
  4. Reverse engineer: Reverse engineer, decompile, or extract the source code of our software;
  5. Fraudulent use: Use the service to defraud, deceive, or otherwise cause harm to StickTime FPV or any other person, or for any commercial purpose not authorized under Section 6; or
  6. Dangerous operation: Use platform data to pilot drones recklessly, dangerously, or over non-consenting crowds/property.

6. License Tier Restrictions; Scope of Use by Tier

The Free, Pro, and Team (Hobbyist) tiers are licensed strictly for personal, non-commercial, non-monetized use. Team's bundled group pricing does not change that restriction for any pilot on the team. Any commercial operation, client work, or business use constitutes a material breach of these Terms and will result in immediate account termination. Commercial use requires an Enterprise Solo, Education, or Enterprise tier.

  • Free, Pro, and Team (Hobbyist) scope: Your Free, Pro, or Team subscription is a personal, revocable license to use the Platform for your own individual hobby, recreation, and skill development. It does not grant any right to use the Platform on behalf of, for the benefit of, or at the direction of any business, employer, client, or paying third party.
  • Team scope: A Team subscription bundles between five (5) and ten (10) individually named hobbyist pilots under a single group price for shared club rosters, joint flight logs, team billing, and a group activity feed. Every pilot on the team must still hold their own authorized profile under §7. Team pricing changes only how the group is billed, not the non-commercial restriction, which applies in full to every pilot on the team individually.
  • Prohibited commercial use: Without limitation, the following constitute commercial use and are strictly forbidden on the Free, Pro, and Team tiers: paid client work or services; footage, data, or analytics produced for sale or license; promotional, marketing, advertising, or monetized content production; operations for any employer or business entity; and any use for which you or a third party receive compensation, directly or indirectly.
  • Material breach; termination: Any commercial operation, client work, or business use of a Free, Pro, or Team account constitutes a material breach of these Terms. Upon detection, your account (and, for Team, the offending pilot's seat) is subject to immediate termination without refund of the then-current billing period, and you remain liable for fees equal to the difference between what you paid and the commercial tier you should have held for the period of misuse.
  • Enterprise Solo scope: An Enterprise Solo subscription licenses exactly one (1) individual commercial pilot for their own paid drone operations. It does not extend to any other operator, employee, contractor, or business entity. A business with more than one commercial pilot requires an Enterprise agreement covering its full roster.
  • School scope: A School subscription licenses one (1) educational institution for use by its enrolled students and authorized staff, each provisioned their own school-managed profile by an administrator. It covers institutional, instructional use only and is not a substitute for an Enterprise agreement if the institution also conducts commercial drone operations outside its educational program.
  • Enterprise scope: An Enterprise subscription licenses the specific business entity and seat count set out in its order or agreement. Use beyond the contracted seat count, or by any entity other than the contracting business and its authorized personnel, requires a seat true-up or a separate agreement.
  • Verification: Every commercial tier (Enterprise Solo, Enterprise, and School) is verified and provisioned server-side. Self-reporting a non-commercial status you do not hold, or a tier scope broader than what you actually hold, is itself a material breach.

7. Single-User Accounts; No Credential Sharing or Seat Pooling

Login credentials are strictly for single-user access. Sharing credentials, pooling individual accounts, or allowing multiple distinct operators or students to access the platform through a single user account is strictly prohibited. Every individual pilot, student, or operator must maintain their own authorized, paid seat or school-managed profile.

  • One human, one account: Each account may be used only by the individual who registered it. You may not share your login credentials with any other person, allow any other person to operate under your account (concurrently or otherwise), or pool multiple individual accounts for use by a group, household, classroom, team, or organization.
  • Per-seat licensing: Every individual pilot, student, or operator who accesses the Platform must maintain their own authorized, paid seat, or be provisioned with their own school-managed profile by an authorized administrator. Circumventing per-seat licensing through credential sharing, simulated or parallel sessions, or account pooling is strictly prohibited.
  • Enforcement: We monitor for concurrent and anomalous session activity consistent with single-user licensing. Violations may result in immediate suspension or termination of the shared account, termination of all accounts participating in the pool, and a per-seat true-up charge for the full period of misuse.
  • Organizations: Schools and enterprises must provision each member individually through their administration tooling and remain responsible for seat-count accuracy under their agreement.

8. Disclaimers ("AS IS" and "AS AVAILABLE")

YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK. THE PLATFORM AND ALL ASSOCIATED ANALYTICS, SOFTWARE, AND SERVICES ARE PROVIDED ON an "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, STICKTIME FPV DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES, OR THAT FLIGHT DATA OR ANALYTICS WILL BE ACCURATE OR RELIABLE.

9. Mandatory Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

(a) Application: You and StickTime FPV agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or your use of the services will be settled exclusively by binding individual arbitration, rather than in a court of law.

(b) Class Action and Jury Trial Waiver: YOU AND STICKTIME FPV AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND STICKTIME FPV HEREBY WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT. The arbitrator may not consolidate more than one person's claims or preside over any form of a class or representative proceeding.

(c) Small Claims Court Exception: Notwithstanding the agreement to arbitrate, either party may bring an individual action in a small claims court of competent jurisdiction.

(d) Opt-Out Right: You have the right to opt out of this arbitration agreement and class action waiver. To opt out, you must send a clear written notice to [INSERT SUPPORT/LEGAL EMAIL] within thirty (30) days of first creating your account. If you do not opt out within 30 days, this section is fully binding.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law principles. For any dispute not subject to arbitration under Section 9, you consent to the exclusive personal jurisdiction of the state and federal courts located in Oklahoma.

11. Severability

If any provision of these Terms (including the class action waiver or arbitration clause) is found by a court or arbitrator to be invalid, illegal, or unenforceable, that specific provision will be limited or removed to the minimum extent necessary. The remaining provisions of these Terms will remain in full force and effect.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STICKTIME FPV, ITS FOUNDERS, OFFICERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, DRONE LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT STICKTIME FPV HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL STICKTIME FPV'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO STICKTIME FPV (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to defend, indemnify, and hold harmless StickTime FPV, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the platform; (c) your violation of any third-party right, including any intellectual property, privacy, or aviation/property law; or (d) any physical damage, injury, or death caused by your drone operations, whether informed by our analytics or not.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this policy. Your continued use of the platform after changes become effective constitutes your binding acceptance of the updated terms.

15. Billing, Subscriptions, and Refund Policy

All purchases of Pro features, subscriptions, or digital upgrades are final. Once digital access or Pro features have been activated or used, the purchase is strictly non-refundable.

Subscriptions may be cancelled at any time. Upon cancellation, you retain Pro access through the end of your current billing cycle, after which the subscription will not renew. No partial or prorated refunds are issued for unused time remaining in a billing cycle.

Exceptions for verified billing errors or technical issues that prevented access to paid features may be reviewed on a case-by-case basis at StickTime FPV's sole discretion. Approval of an exception in one instance does not obligate StickTime FPV to grant an exception in any other instance.

Price Changes: We reserve the right to change subscription fees at any time. If a price change affects your subscription, we will notify you in advance and give you the opportunity to cancel before the new price takes effect on your next billing cycle. Continuing your subscription after a price change takes effect constitutes acceptance of the new price.

Taxes: Displayed prices do not automatically include applicable local taxes, VAT, or other fees. Where required, such taxes and fees will be calculated and added at checkout based on your location.

16. File Storage

Scope: file storage is part of the Enterprise tier only. The Free, Pro, and Team tiers include no organization storage, and an account without an active Enterprise (or Enterprise Solo) plan cannot upload files. The allowance covers every file an organization uploads: documents held in the Compliance Vault (certificates, waivers, medicals), client deliverables, and files in client delivery portals.

Included allowance: an Enterprise plan includes 250 GB per seat, pooled across the plan's organizations. A school plan includes 25 GB per school. A school plan provides the Compliance Vault and not client delivery: a school organization may store Vault documents only, and uploads outside the Vault are refused. Allowances are published on the pricing page and may be changed for future billing periods with notice under Section 14; they are never reduced retroactively.

Measured at peak, not at close: usage is measured continuously and the period's allowance is assessed against the HIGHEST usage reached during that billing period. Deleting files frees space immediately and reduces future periods, but it does not reduce the charge for a period in which that usage was already reached. Overage is billed monthly against that peak and is never committed annually.

Overage is opt-in: uploads beyond the included allowance begin only after the plan's billing owner enables storage overage at the then-current published rate. Until it is enabled, uploads that would exceed the allowance are refused; already-stored deliverables are never deleted for non-payment and remain downloadable.

School plans are capped, not metered: a school plan's 25 GB per school is a hard ceiling. School plans are not eligible for storage overage and cannot exceed it under any configuration.

Cancelling does not delete: cancelling a subscription, or turning off storage overage, never deletes stored files. Overage may stop while files remain; the allowance is enforced by refusing new uploads, not by removing anything, and previously delivered work and Vault documents stay downloadable throughout.

Empty organizations are deleted: if an organization has no members left in it for thirty (30) consecutive days, we delete the organization and all of its contents, including Compliance Vault documents. This is the one circumstance in which stored files are removed without anyone asking us to. The purpose of the period is to allow an organization that has lost its members by mistake to re-invite them and keep everything; after thirty days there is no member entitled to the records, and we no longer carry the storage cost of an organization nobody can reach. Re-inviting a member during the period ends the deletion entirely.

Retained versions count: the allowance measures files actually held in storage, including superseded document versions and files for deliveries that have since expired, because those bytes remain stored until they are deleted.

17. Third-Party Trademarks & Disclaimer

StickTime FPV is an independent, third-party application and is not affiliated with, endorsed by, or sponsored by any drone, simulator, or hardware manufacturer. Any third-party names, logos, or trademarks referenced within this application (including but not limited to VelociDrone, Liftoff, Uncrashed, and DJI) are used solely for identification, description, and compatibility purposes (e.g., to indicate supported simulators or hardware). All trademarks, service marks, and trade names are the property of their respective owners. Use of these names does not imply any affiliation, sponsorship, or endorsement between StickTime FPV and the trademark holders.
